Because criminal cases are initiated by police officers and prosecutors, their stories are usually the first to be heard publicly. The lawfulness of an arrest or indictment will rest on the story that is told by police and prosecutors. It is unavoidable that their story will be written with a law enforcement bias, as their underlying purpose will always be to justify their actions and establish that a crime was committed. Their story will be pieced together from witness testimony, physical evidence and, often, the results of scientific testing. And if you’ve already spoken with the police, some of their story will be written using your own words.
